AI SIX Podcast Episode 460: What is an AI Sandbox?

By

What is an AI regulatory sandbox, and why should public sector organisations care right now? In this episode, I break down how AI sandboxes work under the EU AI Act, where Ireland stands after its deadline shifted by a full year, and why this is the most under-used opportunity in the entire Act.

What an AI Regulatory Sandbox Actually Is

Article 57 of the EU AI Act requires every EU member state to set up at least one national AI regulatory sandbox. It is a controlled environment where you develop, train, test and validate an innovative AI system before it goes to market — working to a plan you agree in advance with the regulator.

I like to think of it as a driving instructor’s car. You are driving. The instructor is beside you with a second set of pedals. You are on a real road with real traffic — not going around an empty car park. But if something goes badly wrong, someone else can stop the car. That is a sandbox. Real system, real supervision, real stakes, with a hand on the brake.

What You Get — and What You Do Not

Here is what participation actually gives you:

  • A regulator in the room telling you what compliance looks like for your specific system, not a textbook example
  • Written proof of what you completed, plus an exit report that market surveillance authorities must take positively into account
  • No administrative fines under the AI Act, provided you stick to the agreed plan and follow guidance in good faith

But here is what I hear people get wrong. You remain fully liable under normal liability law for any damage caused to a third party. The authority keeps all its supervisory powers. And if a significant risk to health, safety or fundamental rights appears and cannot be mitigated, they can suspend your testing or remove you from the sandbox entirely. It is dual controls, not a get-out-of-jail-free card. Big difference.

Where Ireland Actually Sits Right Now

Credit where it is due — Ireland moved early. In September 2025, we designated 15 competent authorities under the AI Act, making us one of the first six member states to do so. The Data Protection Commission, the Central Bank, Coimisiún na Meán, the Health and Safety Authority, and more.

The Regulation of Artificial Intelligence Bill 2026 sets up an AI Office of Ireland as our central coordinating authority, and that office will run our national sandbox with priority access for SMEs and start-ups.

The Digital Omnibus on AI received final Council approval on 29 June, was signed on 8 July, and at the time of recording was awaiting publication in the Official Journal. The headline was the high-risk delay — stand-alone Annex III systems like recruitment, credit scoring, and education tools move from August 2026 to 2 December 2027. But buried in that: the sandbox deadline also moved, from 2 August 2026 to 2 August 2027.

Why the Delay Makes This More Urgent, Not Less

The delay is honest — the harmonised standards were not ready, and you cannot assess anyone against standards that do not exist yet. But sandboxes are already the single most under-used idea in the entire AI Act, and an extra year makes that worse.

If you are a public body or a small organisation nervous about deploying AI, a sandbox is the cheapest legal certainty you will ever be offered. Most of the organisations I train every week would absolutely jump at a regulator telling them what good looks like before they spend the money — they just do not know it exists yet.

The real risk of the extra year is that everyone hears 2027 and stops thinking about it. Do not. The queue for that sandbox will be short in year one and very long after that.
